Terms of Service
These terms set out the rules for using Keniyo, the WhatsApp CRM and automation platform operated by Keninsula Software Solutions.
Acceptance and your account
By creating an account, connecting a channel, or using Keniyo, you agree to these Terms of Service and our Privacy Policy. If you use Keniyo on behalf of a company, you confirm that you have authority to bind that company.
You must provide accurate account information, keep credentials secure, and promptly tell us about unauthorized access.
Using Keniyo responsibly
You may use Keniyo only for lawful business purposes and in accordance with these terms, applicable law, and the policies of platforms you connect. You must not use Keniyo to send spam, deceptive content, unlawful content, malware, or messages without the appropriate recipient consent.
When using Meta or WhatsApp services, you must comply with their applicable terms, commerce policies, messaging policies, template requirements, and any permissions or consent requirements. Meta or WhatsApp may independently limit, reject, or suspend your business assets or messages.
Your data and content
You retain your rights in the content and data you submit to Keniyo. You grant us the limited rights needed to host, process, transmit, and display that data solely to operate and support the service for you.
You are responsible for the data you upload, your communications with contacts, and obtaining all permissions required to use that data. You must not upload data that infringes another person's rights or violates applicable law.
Plans, billing, and third-party fees
Paid features, plan limits, and billing terms are shown when you select a plan. You are responsible for applicable taxes and for charges from third parties, including Meta or WhatsApp conversation, template, advertising, and business-account charges where applicable.
We may change plans or pricing prospectively with reasonable notice where required.
Availability and changes
Keniyo is provided on an “as is” and “as available” basis. We work to keep it reliable and secure, but we do not guarantee uninterrupted, error-free, or loss-free operation. We may modify, suspend, or discontinue features when reasonably necessary to operate, secure, or improve the platform.
Suspension and termination
You may stop using Keniyo at any time. We may suspend or terminate access if we reasonably believe there is a security risk, non-payment, unlawful use, policy breach, or harm to Keniyo, its users, or third parties. Upon termination, your right to use the service ends. Our data-deletion process is described in the Data Deletion Instructions.
Liability and contact
To the maximum extent permitted by applicable law, Keninsula Software Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from use of Keniyo.
